Legal Stuff -- Terms and Conditions
Contracting the services of Casa Cielo Editing implies acknowledgment and acceptance of the terms and conditions as detailed in this document:
- Casa Cielo Editing will advise the client as to the most appropriate service for his/her project. However, the client is responsible for selecting the services he/she deems appropriate to his/her specific needs. Casa Cielo Editing will not take responsibility if the service provided does not meet the client's specific requirements.
- If the client needs Casa Cielo Editing to use any specific terminology in any of its services, the client is responsible for providing Casa Cielo Editing with any reference materials. If none of these are provided, Casa Cielo Editing will use the terminology it deems appropriate to the assignment, according to professional judgment.
- Word count is taken from the initial document and is determined by use of software when possible. Manuscripts must be formatted following Casa Cielo Editing's submission guidelines. You will be charged extra if your manuscript fails to meet these guidelines:
- DOC or ODT format only
- One inch margins
- Times New Roman, 12 point
- Double-spaced
- Half-inch indents on paragraph first lines
- Turn-around time will be explained in the quotation. Most commissions require at least 15 days. A surcharge will be applied to all rush orders in the amount of 20% of the total price.
- Clients retain copyright, ownership, intellectual property, and control over all materials submitted, including any documents subsequently created by Casa Cielo Editing. Casa Cielo Editing assumes no liability for the infringement of third party copyright in the content of clients' documents. It is the client's sole responsibility to properly research and include all acknowledgments and citations within their text. It is the sole responsibility of the client to abide by the copyright laws. The client shall not make Casa Cielo Editing responsible for the breach of copyright laws by the use of its services. Where copyright exists in texts presented for service by Casa Cielo Editing, the client warrants that all the necessary consents have been obtained for such a service to be carried out.
- Casa Cielo Editing will not disclose any proofreading or editing job to potential clients, outside agencies, or other individuals without the explicit consent of the client, except where required by law.
- After being contacted by the client, Casa Cielo Editing will elaborate a quotation with detailed information about the services requested. Quotations are not binding, and they will only be deemed a contract once they have been accepted and signed by both the client and Casa Cielo Editing. Electronic signature via e-mail will be considered binding. Quotations are valid for a period of 15 days from their preparation date. The starting date of a project will be the same as the date of acceptance of a quotation. Any quotation accepted after 5:00 p.m. Arizona time, will be considered to have been accepted the following business day.
- Casa Cielo Editing will make every reasonable effort to meet agreed delivery dates specified on a contract. However, completion dates are only best estimates, and Casa Cielo Editing will not be liable for the consequences of any delay. Casa Cielo Editing reserves the right to modify delivery dates, if necessary; in which case, the client will be notified in advance. Late deliveries shall not entitle the client to withhold payment for any work completed. Casa Cielo Editing shall not be made responsible, under any circumstances, for the consequences of any delays or delivery problems resulting from a mistake made by suppliers, subcontractors, delivery services, or adverse conditions. Final documents can be sent by e-mail or client-arranged courier service (USPS, UPS, FedEx, etc.). Any courier service costs incurred will be met by the client, and the delivery time necessary for this service will be taken into account in the final delivery date of the project.
- Casa Cielo Editing reserves the right to apply a surcharge to the quoted price if the client makes any changes to the original project once the work has been initiated. Any cancellations of projects already commissioned by the client will require a written, hard-copy confirmation on the part of the client, as well as a notification by e-mail. Casa Cielo Editing reserves the right to issue an invoice for all work completed up-to and including the cancellation date and for any other additional costs that may have been incurred as a result of such cancellation. Casa Cielo Editing will notify the client, as soon as possible, of any circumstances which could prevent Casa Cielo Editing from supplying the requested services. Casa Cielo Editing will then do everything possible, within reason, to help the client find an alternative solution. Casa Cielo Editing reserves the right to subcontract, if necessary, any or all work to be performed, to other professionals who fulfill quality requirements.
- All prices are in USD. Clients are responsible for any and all transfer, currency exchange, PayPal, or other fees.
- A 50% deposit is due at signing, with the remainder due immediately upon delivery. Under certain circumstances, an invoice will be issued upon delivery of final documents. PayPal is the only method of payment accepted by Casa Cielo Editing. Any bank charges incurred related to the payment of services are the responsibility of the client.
- A weekly penalty fee will be applied to delayed payments. A 2% surcharge will be added to the total sum of the original invoice for the first week of delay in payment. For every subsequent week without payment, another 2% will be added to the outstanding value of the previous week until payment has been received in full. If Casa Cielo Editing hires the services of a lawyer or a debt collection agency in order to claim an outstanding payment from a client, any related costs or commissions derived from such service will be the responsibility of the client.
- Casa Cielo Editing is neither responsible nor liable for any damage to computer hardware, software, websites, content, or other assets arising from the distribution of computer viruses.
- Casa Cielo Editing endeavors to offer quality services and guarantees that all services provided will be carried out by professional proofreaders, writers, editors, etc., who fulfill quality requirements. However, Casa Cielo Editing cannot guarantee completely error-free documents; however, Casa Cielo Editing will correct any errors free of charge.
- All clients must acknowledge and agree to Casa Cielo Editing's refund policy: all editorial and consulting services are performed to the best of our abilities, begin immediately upon ordering, and will be rendered in good faith. In the event a document submitted for editing or proofreading fails to meet the client's requirements after re-editing or re-proofreading, Casa Cielo Editing offer a refund of up to 100% on a case-by-case basis. All incurred fees (courier services, PayPal, bank, etc.) are the responsibility of the client regardless of project refund. No returns or refunds will be issued for editing services canceled by the client. The client has seven days from receipt of the completed assignment to notify Casa Cielo Editing in writing of any mistakes or omissions in the delivered work or of any other issues related to the provision of services. Casa Cielo Editing will then make all necessary corrections without any additional cost and within a reasonable amount of time, provided those issues are justified.
- The client is responsible for making certain the documents provided do not include content which could constitute a breach of law. Casa Cielo Editing shall not be required to work on any materials which in our opinion are or may be of an illegal, libelous, inflammatory, or treasonous nature. Casa Cielo Editing reserves the right to refuse certain texts, projects, fonts, document types, and assignments without having to give any due reason.
